TollMate Terms of Use and Disclaimer

These terms apply to your use of the TollMate app. Please read them before using the app. By downloading or using TollMate you agree to these terms. A summary of the key points is also shown in the app during onboarding and in the Settings tab.

1. Who we are

TollMate is developed and published by Jason David Galloway, a sole trader based in England. You can contact us at [email protected].

2. What TollMate is and is not

TollMate is a reminder aid. It uses your device location to detect when you may have crossed one of the six monitored UK toll crossings listed in the app and reminds you that a payment may be due.

TollMate is not a payment service. It does not pay tolls or charges on your behalf, does not hold or transmit payment details, and has no connection to any toll operator's payment or enforcement systems.

TollMate covers only the six crossings listed in the app. It does not cover, detect, or remind you about any other road charge, including the London Congestion Charge, ULEZ, Clean Air Zones, or any toll road or crossing not listed in the app.

3. Safety: never use TollMate while driving

For your safety, never use TollMate while driving. Under UK law you are still driving when stopped in traffic or at lights with the engine running. Only use TollMate when you are safely parked with the engine switched off. Reminders will wait for you.

4. Detection has limits

TollMate detects crossings using your device's location services. Detection depends on factors outside our control, including:

  • your device's location permissions. TollMate requires "Always" location access to detect crossings in the background
  • Precise Location being switched on for TollMate. Without Precise Location your device reports only an approximate area, which is not accurate enough to detect a crossing
  • your device's background activity settings, including Background App Refresh
  • the app not having been force-quit. If you force-quit TollMate, or your device restarts and you do not reopen the app, background detection may not resume until you next open it
  • satellite and mobile signal quality, which varies by location, weather, and device
  • Low Power Mode and other battery settings, which can reduce background activity
  • your device's operating system behaviour, which we do not control

Because of these factors, TollMate may miss a crossing, detect one late, or record a crossing you did not make. TollMate cannot guarantee that every crossing will be detected and must not be your only means of remembering to pay a toll.

5. Reminders depend on your notification settings

Reminders are delivered as notifications and can only reach you if notifications are allowed for TollMate. TollMate marks payment reminders as time sensitive, which allows them to reach you through Do Not Disturb and Focus modes if you have allowed Time Sensitive Notifications for TollMate in your device Settings. If notifications are turned off, or Time Sensitive Notifications are not allowed, reminders may be silenced or delayed by Do Not Disturb, a Focus mode, or any other setting that hides notifications. You are responsible for checking that your device settings allow TollMate notifications to reach you.

6. Deadlines and crossing information are a guide only

Payment deadlines, charging hours, and toll amounts shown in the app are based on our understanding of each operator's published terms at the time the app was last updated. Operators can change their deadlines, charges, and terms at any time and without notice to us. Treat any deadline or amount shown in TollMate as a guide only and always check the operator's own terms before relying on them.

Crossing times recorded by TollMate are approximate, have no official status, and may differ from the operator's own record. In any dispute with an operator, the operator's record applies, not TollMate's.

7. You remain responsible for paying

You remain solely responsible for paying any toll, charge, or penalty, and for doing so on time, whether or not TollMate detected the crossing, sent you a reminder, or showed an accurate deadline.

8. No affiliation with toll operators

TollMate is not affiliated with, endorsed by, or connected to any toll operator or road authority, including Merseyflow, Dart Charge, TT2, Warburton Toll Bridge, or the Humber Bridge Board. All operator names are used only to identify the relevant crossings.

9. Payment links

Links to operator payment pages are provided for convenience only. We do not control those pages and are not responsible for their content, availability, or accuracy. Always check you are on the correct official page before entering payment details.

10. Purchases and refunds

Purchases and subscriptions for TollMate are made through Apple's App Store and are subject to Apple's terms. Payment is taken by Apple, not by us. Refund requests are handled by Apple through its standard refund process at reportaproblem.apple.com. Subscriptions can be managed or cancelled at any time in your Apple account settings. Your statutory rights are not affected.

11. Your data and privacy

Your location is processed only on your device. We do not collect, receive, store, or have access to your location, your crossing history, or any other personal information.

If you have iCloud enabled, your crossing history and settings may sync between your devices using Apple's iCloud service. This data is stored in your personal iCloud account under Apple's terms and privacy policy. We have no access to it.

A diagnostic log is stored on your device to help troubleshoot detection issues. It stays on your device unless you choose to share it with us.

TollMate contains no third-party analytics or crash-reporting. Apple may provide us with anonymised, aggregated App Store statistics that cannot identify you.

12. Licence

We grant you a personal, non-transferable, non-exclusive licence to use TollMate on Apple devices that you own or control, for personal, non-commercial use only, in accordance with these terms and Apple's App Store terms. You must not copy, modify, reverse engineer, or redistribute the app except as permitted by law.

13. Availability and changes to the app

We may update, change, or withdraw features of TollMate at any time, including the list of monitored crossings. We do not guarantee that the app will always be available, uninterrupted, or error-free. We will provide the app with reasonable care and skill, and your rights under the Consumer Rights Act 2015 in relation to digital content are not affected.

14. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 in relation to digital content, are not affected.

Subject to the paragraph above, and to the extent permitted by law:

  • we are not liable for any toll, charge, penalty charge notice, fine, or other loss arising from a crossing that TollMate did not detect, detected late, or recorded inaccurately, or from a reminder that was not delivered or not seen, or from reliance on any deadline, amount, or other information shown in the app
  • we are not liable for losses caused by events outside our reasonable control, including operator changes, App Store or iCloud outages, or device and network failures
  • TollMate is licensed for personal, non-commercial use, and we are not liable for any business losses, including loss of profit, revenue, or business opportunity
  • our total liability to you in connection with TollMate is limited to the amount you have paid for the app in the twelve months before the event giving rise to the claim

15. Ending your use of TollMate

You can stop using TollMate at any time by deleting the app. We may suspend or end your access to the app if you seriously breach these terms. Sections that by their nature should survive, including sections 7 and 14, continue to apply after you stop using the app.

16. Changes to these terms

We may update these terms from time to time, for example to reflect changes to the app or the law. The current version will always be available at this page, with the date of the last update shown at the top. If a change materially affects your rights, we will take reasonable steps to bring it to your attention, such as a notice in the app.

17. General

If any part of these terms is found to be unenforceable, the rest remains in effect. These terms are between you and us; no one else has rights under them. Our failure to enforce any part of these terms is not a waiver of it.

18. Governing law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also rely on the law of, and bring proceedings in, the part of the UK where you live.
